MI Paid Sick Leave and Minimum Wage

On July 31, 2024, the Michigan Supreme Court ruled that “Adopt and Amend” legislative procedures were unconstitutional. This means the original language of the petitions adopted by the legislature in 2018 regarding Paid Sick Leave and Minimum Wage will go into effect on February 21, 2025.

NFIB is advocating for legislative fixes to the law, but as of now the law states:

The Paid Sick Leave legislation affects all employers with one or more employees and allows for up to 72 hours of sick leave a year to be accrued. It also has a myriad of regulations and restrictions on employers on how that sick time is calculated and used, including a prohibition on requiring advance notice. This applies to all employees including part-time, seasonal, and temporary employees.

The Minimum Wage legislation increases the minimum wage to somewhere between $14 – $15 by 2028 (calculations are still being made), eliminate the tip credit for restaurant servers, and continue to increase the minimum wage each year by the consumer price index.

Tell Legislators to Make Critical Changes to Paid Sick Leave Minimum Wage Before They Go into Effect.

In January 2025, the Michigan House passed HB 4001 and HB 4002 which would restore the restaurant server tipped wage and modify the Earned Sick Time Act. NFIB and small businesses urge the Michigan Senate to also pass this important legislation before it’s too late.
