Washington, D.C. (June 27, 2018) – NFIB, the nation’s leading small business advocacy organization, issued the following statement today on behalf of President and CEO Juanita Duggan following the announcement of United States Supreme Court Justice Anthony Kennedy’s retirement:
“As the lead plaintiff in the historic challenge to the Affordable Care Act, NFIB v. Sebelius, NFIB understands first-hand the importance one justice can have on the ability of small businesses to succeed or fail. That is why NFIB thoroughly reviewed the record of and took an early stand on the nomination of Judge Merrick Garland, and why we actively supported the nomination of Justice Neil Gorsuch.
“The retirement of Justice Kennedy creates another vacancy on the Supreme Court and NFIB will again evaluate the record of the next nominee. In particular, we will review how he or she has approached the so-called ‘Chevron Doctrine,’ under which the courts often defer to regulatory agencies on the interpretation of statutes.
“Small and independent business have one of the biggest stakes in the Supreme Court make-up, and as the country’s leading advocate for small businesses, NFIB will be watching the next nomination closely and weigh in on where the next nominee’s record stands on business issues.”
