Washington, D.C. (February 25, 2019) – NFIB filed an amicus brief in the case of Food Marketing Institute v. Argus Leader Media late last week, arguing that the United States Supreme Court should protect confidential information.
“Small business owners have every expectation of maintaining privacy in confidential information,” said Karen Harned, Executive Director of the NFIB Small Business Legal Center. “We urge the Supreme Court to safeguard small business rights by holding that FOIA precludes the release of all confidential information about a small business, not just information that someone thinks especially ‘critical.”
Food Marketing Institute v. Argus Leader Media primarily concerns the Freedom of Information Act (FOIA), which allows journalists and other interested members of the public to request documents from the federal government. In this case, the Supreme Court is set to decide whether and when federal agencies may deny a FOIA request for information collected on businesses.
The NFIB Small Business Legal Center protects the rights of small business owners in the nation’s courts. NFIB is currently active in more than 40 cases in federal and state courts across the country and in the U.S. Supreme Court.
